69:1
Imperator Justinianus Augustus Petro gloriosissimo magistro sacrorum nostrorum officiorum. De dispensatione. et privilegiis, aliisque diversis capitulis earum rerum quæ ad sacrosanctas ecclesias et alias venerabiles domos pertinent, nonnulla jam ad certam redegimus formam, In praesentia vero ea que religiosissimos concernunt episcopos, clericos, et monachos, in diversis pridem disposita constitutionibus, hac lege cum competente nobis correctione complecii visum est.

The Emperor Justinian Augustus to Peter, the most glorious master of our sacred offices. Concerning the administration and privileges, and other various chapters of those matters which pertain to the most holy churches and other venerable houses, we have already reduced certain points to a fixed form. But at present it has seemed good to embrace, in this law with a correction befitting us, those things which concern the most religious bishops, clergy, and monks, formerly ordained in various constitutions.
69:2
Nam si leges civiles, quorum potestatem fidei nostræ Deus pro suo erga homines amore concredidit, per omnia firmas ac stabiles conservari ad subditorum securitatem studemus, quanto plus studii debemus circa sacrarum regularum et divinarum legum observationem reponere, quæ pro salute animarum nostrarum definitæ ct constitutæ sunt? Qui enim sacros observant canones, hi Domini Dei potiuntur auxilio; et qui in hosce praevaricantur, ii seipsos condemnationi subjiciunt. Majori autem condemnationi obnoxii erunt religiosissimi episcopi, quorum fide i commissa est canonum inquisitio et custodia, si quid in his transgressum inultum reliquerint.

For if we are zealous that the civil laws, the power of which God in His love toward men has entrusted to our fidelity, be preserved firm and stable in all things for the security of our subjects, how much more zeal ought we to bestow upon the observance of the sacred canons and divine laws, which were defined and established for the salvation of our souls? For those who observe the sacred canons obtain the help of the Lord God; and those who transgress against these subject themselves to condemnation. But the most religious bishops, to whose fidelity is committed the inquiry and custody of the canons, will be liable to a greater condemnation, if they leave any transgression in these matters unpunished.
69:3
Sacris Banc canonibus non observatis, varias contra der!cos, et monachos, ac nonnullos episcopos interpellationes suscepimus, quod secundum sacros canones vitam non instituant. Alii etiam ne ipsas quidem sacræ oblationis et sacri baptismatis preces scire dicuntur. Dei itaque judicium revolventes in animo, in unoquoque horum quæ renuntiata nobis sunt, quæstionew et correctionem canonice jussimus procedere. Nam si generales leges ea quae perperam admittuntur a laicis non concedunt sine quaestione et vindicta relinqui, quomodo ea quae a sanctis apostolis et patribus ad fidelium hominum salutem regulariter disposita sunt, despici suslineamus ?

Since these sacred canons are not observed, we have received various complaints against clergy and monks, and against some bishops, that they do not order their life according to the sacred canons. Some are even said not to know the very prayers of the sacred oblation and of holy baptism. Revolving therefore the judgment of God in our mind, we have commanded that in each of these matters which have been reported to us, inquiry and correction proceed canonically. For if the general laws do not permit those things which are wrongly admitted by laymen to be left without inquiry and punishment, how should we endure that those things which have been ordered in a regular manner by the holy apostles and fathers for the salvation of faithful men be despised?
69:4
Multos praeterea ex hoc deprehendimus in peccata incidisse, quod synodi religiosissimorum sacerdotum secundum ca quæ a santis apostolis et sanctis Patribus praefinita sunt non celebrentur. Namque si id observatum fuisset, unusquisque reveritns subeundam a se in synodo redargutionem, studuisset utique et sacra ediscere ministeria, et honeste vivere, ne condemnationi subjiceretur sacrorum canonum. Sed et illud plerisque non parvam delinquendi occasionem praebuit, quod episcopi ac presbyteri, neque non diaconi, et reliqui clerici sine examinatione et de recta fide et vitæ honestate testimonio ordinentur.

Besides, we have discovered that many from this cause have fallen into sins, namely that the synods of the most religious priests are not celebrated according to those things which were prescribed by the holy apostles and holy Fathers. For if this had been observed, each one, revering the rebuke he would undergo in the synod, would surely have been zealous both to learn thoroughly the sacred ministries and to live honorably, lest he be subjected to the condemnation of the sacred canons. But that too gave to very many no small occasion of offending, that bishops and presbyters, and likewise deacons and the rest of the clergy, are ordained without examination and without testimony of right faith and honesty of life.
69:5
Nam si illi quibus negotium datum est orandi pro populo, indigni ministerio Dei inventi fuerint, quomodo pro populi delictis placare Deum poterunt? Quod vero ordinationes sacerdotum conveniat cum summa fieri diligentia, docet nos inter sanctos habitus Gregorius Theologus, santos apostolos et sacros secutus canones. Ita enim dicit in magno Apologetico:« Quis autem ad Pauli se regulas et præscripta dimetiens quæ de episcopis et presbyteris fecii, ut sobrii sint, modesti, non vinolenti, non percussores, instructi ad docendum, irrepreherisibiles in omnibus, et nihil cum improbis habentes commercii, non deprehendat multum se ab bac rtgularum rectitudine discrepare? > Et rursus idem sic dicit:

For if those to whom the business of praying for the people is given are found unworthy of the ministry of God, how shall they be able to appease God for the offenses of the people? But that the ordinations of priests ought to be done with the utmost diligence, Gregory the Theologian, numbered among the saints, teaches us, following the holy apostles and the sacred canons. For thus he says in his great Apologetic: «But who, measuring himself by the rules and prescriptions of Paul, which he made concerning bishops and presbyters, that they should be sober, modest, not given to wine, not strikers, equipped to teach, irreproachable in all things, and having no commerce with the wicked, would not perceive that he differs much from this rectitude of the rules?» And again the same says thus:

c Mundum prius esseoportet, deinde mundare; instructum sapientia, atque ita ad sapientiam instruere; lucem fieri, et illuminare; appropinquare Deo, et alios ad Deum adducere; sanctum esse, et sanctificare; deducere, sed cum manibus; dare consilium, sed cum prudentia. » Et rursus idem in sanctis habitus Gregorius de iisdem in eadem oratione hoc scribit: « Quis, obsecro, quasi figlina uno eodemque die fingat veri ministerii antistitem, qui cum aliis angelis stationes habeat, cum archangelis laudes Deo dicat, cum Christo sacerdotali fungatur munere? » Et per hæc quidem ostendit Theologus quales ad sacerdotium promoveri oporteat.

«One must first be cleansed, then cleanse; be instructed in wisdom, and so instruct in wisdom; become light, and enlighten; draw near to God, and lead others to God; be holy, and sanctify; lead by the hand, but with hands; give counsel, but with prudence.» And again the same Gregory, numbered among the saints, writes this concerning the same in the same oration: «Who, I beseech, would fashion, as if of clay, in one and the same day, a prelate of the true ministry, who should keep his stations together with the other angels, sing praises to God together with the archangels, and discharge a priestly office together with Christ?» And by these things indeed the Theologian shows of what sort those ought to be who are promoted to the priesthood.
69:7
De his vero qui indigne ordinantur, idem hæc dicit in eadem oratione: « Qui cum nihil antea in sacrum Pei alveare intulerint, nihil antea laboris ad id quod pulchrum est assequendus sustinuerint, simul discipuli et magistri pietatis designantur, et prius quam purgentur ipsi, purgant: heri sacrorum direptores, hodie sacerdotes; heri a sacris alieni, hodie sacrorum principes: vetcrani malius, tlyrones pietate, beneficio humanæ gratiæ, non spiritue. i Quod autem cos quialterarn duxerunt uxorem sacri canones clericos esse prohibeant, in sanctis etiam habitus Basilius docens, ita inquit: « Eos qui nuptias iterarunt, canon exclusit ministerio. » Atque hæc quidem inter sanctos habitus Basilius.

But concerning those who are ordained unworthily, the same says these things in the same oration: «Who, having previously brought nothing into the sacred hive of God, having previously undergone no labor toward attaining that which is beautiful, are at once designated both disciples and masters of piety, and, before they are themselves purged, they purge: yesterday plunderers of holy things, today priests; yesterday strangers to sacred things, today princes of sacred things: veterans in wickedness, recruits in piety, by the benefit of human favor, not of the Spirit.» But that the sacred canons forbid those who have taken a second wife to be clergy, Basil also, numbered among the saints, teaching, thus says: «Those who have repeated marriage, the canon has excluded from the ministry.» And these things indeed says Basil, numbered among the saints.
69:8
In tantum autem saucti Patres prp sacerdolio gesserunt curam, ut hi qui Niceæ convenerunt ita se habentem canonem ediderint: I Interdixit in universum magna synodus, ne cui vel episcopo, vel pfesbyfero, vel diacono, vel qui omnino in clero constitutus sit, liceat ascititiam secum uxorem habere, præter matrem, ant amitam, materteramve, aut quæ solæ personæ suspicionem effugiunt. i Sequentes igitur ea que sacris definita sunt canonibus, pragmaticam legem facimus, per quamsancimus ut quoties opus fuerit ordinare episcopum, cocat in unum clerici et primates civitatis, cui episcopus dinandus est, et propositis Evangeliis, de tribus personis decreta faciant;

And so greatly did the holy Fathers exercise care for the priesthood, that those who assembled at Nicaea issued a canon to this effect: «The great synod has forbidden altogether that it be lawful for any bishop, or presbyter, or deacon, or anyone whatsoever constituted in the clergy, to have a woman dwelling with him, except a mother, or aunt, or maternal aunt, or those persons only who escape suspicion.» Following therefore those things which have been defined by the sacred canons, we make a pragmatic law, by which we sanction that, whenever it shall be needful to ordain a bishop, the clergy and the leading men of the city for which the bishop is to be ordained shall assemble together, and, the Gospels being set forth, shall make decrees concerning three persons;
69:9
et quisque eorum juret per sacra eloquia, idque ipsis decretis inserant, quod neque largtionem, neque promissionem, aut amicitiam aut gratiam, aut quamcunque aliam affectionem, sed qoud sciant ipsos rectae et catholicæ fidei, ac honestæ vitæ esse et supra tricesimum quintum ætatis annum, hoc elegerint; et quod neque uxorem, neque filios quem piam ipsorum habere sciant, aut concubinam, aut naturales liberos noverint ipsos habuisse, aut habere; Ced et si quis ipsorum prius uxorem habuerit, tamen eam solam, et oeque viduam, neque sejunctam a viro, neque sacris canonibus interdictam habuerit;
並且他們各人須按神聖的聖言起誓,且將此載入決議本身,即他們揀選這些人,既非為賞賜,亦非為任何許諾,亦非為友誼或私情,亦非任何其他偏愛,乃是因他們知道這些人持守正信與大公的信仰、品行端正、年逾三十五歲;並且知道他們中無一人有妻子或兒女,或有妾,亦不知他們曾有或現有私生子女;但若他們中有人先前曾有妻子,卻只有她一位,且她既非寡婦,亦非與丈夫離異者,亦非聖教規所禁止者;
and let each of them swear by the sacred oracles, and let them insert this into the decrees themselves, that it is neither for largess, nor for any promise, nor for friendship or favor, nor any other affection whatsoever, but because they know these persons to be of right and catholic faith, and of honest life, and above the thirty-fifth year of age, that they have chosen them; and that they know none of them to have either a wife or children, or a concubine, nor know them to have had or to have natural children; but if any of them previously had a wife, yet had her alone, and her neither a widow, nor one separated from a husband, nor one forbidden by the sacred canons;
69:10
sed neque curiæ muneribus addictum, neque cohortalem esse aliquem ex bis poverint qui decretis electus est; j ræterquam si curiae muneribus addictus, aut cohoftalis, non minus annis quindecim, monachicam iD monasterio vitam extra omnem calumniam transegerit videlicet; observatione quæ prius a nobis dicta et, per facienda de ipsis decreta, et in his personis custodienda, ut ex tribus illis personis quae decretis hoc modo eliguntur, melior ordinetur, electione et judicio ejus qui ordinandi jus habet. Curialis vero vel officialis qui (sicut dictum est) quindecim annis in monasterio conversatus est, et ad episcopatum provocatus, liber a propria fortuna sit:

but also that they have not known any of these who has been chosen by the decrees to be bound to the duties of a city council, or to be a cohortalis. Except if one bound to the duties of a city council, or a cohortalis, has, for not less than fifteen years, passed a monastic life in a monastery beyond all reproach: the observance, namely, which was previously stated by us, being kept in the decrees to be made concerning them, and in these persons; so that, of those three persons who are thus chosen by the decrees, the better may be ordained, by the choice and judgment of him who has the right of ordaining. But let the curialis or official who (as has been said) has lived fifteen years in a monastery, and is called to the episcopate, be free from his own condition:
69:11
ita tamen, ut Iiberatus a curia, quartam substantiæ suæ partem sibi retineat, reliquis ejus rebus secundum nostram legem curix et publico vindicandis. Damus autem lcentiam decreta facientibus, si quempiam laicorum dignum memorata electione esse putant, ut hunc cum aliis duobus clericis aut monachis eligant, quo magis si laicus hoc modo ad episcopatum eligatur, non repente episcopus ordinetur; sed primo clericis non minus tribus mensibus connumeretur, et ita sanctas regulas et quotidianum ecclesiæ ministerium edoctus, episropus ordinetur. Qui enim alios debet docere, post ordinationem ab aliis doceri non debet.

yet so, that, freed from the curia, he may retain for himself a fourth part of his substance, the rest of his property being claimed for the curia and the public treasury according to our law. But we give license to those making the decrees, if they think any of the laymen worthy of the said election, to choose this man together with two other clerics or monks; the more so that, if a layman be thus chosen to the episcopate, he be not ordained bishop suddenly; but first let him be numbered among the clergy for not less than three months, and so, having been thoroughly taught the holy rules and the daily ministry of the church, let him be ordained bishop. For he who ought to teach others should not, after ordination, be taught by others.
69:12
Si vero (ut evenit) in quibusdam locis non inveniantur tres personx ad talem electionem opportunæ, liceat decreta facientibus in duabus et in una persona decretum facere, omnes tamen dicta a nobis habentes testimonia. Si vero qui debent episcopum eligere cito ipsa decreta intra menses sex id ipsum non faciant, tunc periculo propriæ animæ ille quem ordinare convenit episcopum ordinet, omnibus aliis quae prædiximus observandis. Exigatur autem prius ab eo qui ordinandus est, per eum qui ordinat, libellus cum propriaillius subscriptione, quæ rationem rectæ ejus fidei comprehendat.
但若(如所常有的)在某些地方找不到三位適於此種揀選之人,則作決議者得就兩位或一位作出決議,惟他們全須具有我們所述的佐證。但若那些應當揀選主教者,未在六個月內作出這些決議,那麼,那理當行祝聖者,須以自己靈魂為擔保而祝聖一位主教,並遵守我們上述的其他一切事項。但須先由行祝聖者,向那將要受祝聖者索取一份親筆署名的書面陳述,其中須包含對他正信的說明。
But if (as happens) in certain places three persons suitable for such an election are not found, let it be lawful for those making the decrees to make the decree concerning two or one person, all of them, however, having the testimonies stated by us. But if those who ought to elect a bishop do not make those very decrees within six months, then, at the peril of his own soul, let him whom it befits to ordain ordain a bishop, all those other things which we have aforesaid being observed. But let there first be required from him who is to be ordained, by him who ordains, a written statement with his own subscription, which shall comprise an account of his right faith.
69:13
Pronuntiet autem is sacram etiam oblationem quae in sancta sit communione, et cum caeteris precibus eas quoque quæ in sacro proferuntur baptismate. Subeat insuper is qui ordinatur jusjurandum per sanctas Scripturas, quod neque per se, neque per aliam persona,,, quidquam dederit, aut promiserit, aut postea daturus sit,vel ei qui ipsum ordinat, vel his, qui pro ipso decreta confecerunt, vel cuiquam alii omnium, conferendae in ipsum ordinationis nomine.
他也須誦讀在聖餐中所行的神聖奉獻禱文,並連同其他禱文,也誦讀在聖洗中所宣讀的禱文。此外,受祝聖者須按聖經起誓:他既未親自,也未藉任何他人,給予、或許諾、或日後將給予任何之物,無論是給予那祝聖他者,還是給予那些為他作決議者,或任何其他人,以授予他祝聖之名義。
Let him also pronounce the sacred oblation which is in the holy communion, and together with the other prayers, also those which are uttered in sacred baptism. Let him, moreover, who is ordained undergo an oath by the holy Scriptures, that neither by himself, nor through any other person, has he given, or promised, or shall hereafter give anything, either to him who ordains him, or to those who made the decrees on his behalf, or to anyone else at all, under the name of conferring the ordination upon him.
69:14
Si quis contra memoratam observationem episcopus ordinatus fuerit, tam ipse omnibus modis episeopatu ejiciatur, quam etiam is qui haec contra ordinare præsumpserit, segregetur anno uno a sacro ministerio, et omnis ejus substantia, quae quolibet tempore aut modo in ejus dominium deducta est, propter culpam, quam fecit, dominio ecclesiae, cujus episcopus est, vindicetur.
若有人違反上述規定被祝聖為主教,他既須以一切方式被逐出主教職分,那膽敢如此違規行祝聖者,也須與神聖職事隔絕一年,並且他的全部財產——凡在任何時間或以任何方式歸入他名下者——須因他所犯之過,而歸於他所任主教之教會的所有權。
If anyone be ordained bishop against the said observance, let him both be cast out of the episcopate in every way, and also let him who has presumed to ordain thus against the rule be separated for one year from the sacred ministry, and let all his substance, which at any time or in any manner has been brought into his ownership, on account of the fault which he committed, be claimed for the ownership of the church of which he is bishop.
69:15
Caeterum si quis contra eum qui episcopus aut presbyter, aut diaconus, aut alius clericus, aut etiam præsul monasterii ordinandus est, accusationem aliquam instituat quacunque de causa, quae possit secundum leges aut canones ejus impedire ordinationem, differtor hujusmodi ordinatio, et interponitor prius examinatio accusatione, praesente etiam accusatore, et ea quae ab ipso in crimen delata sunt ad terminum usque persequente. Imo quamvis accusator se absentet, aut moras nectat, Dibilominus sic quoque i, qui ordinationem facturus est, intra menses tres, exactissimam ea de re quaestionem habeto.
但若有人無論出於何種緣由,對那將要受祝聖為主教、或司鐸、或執事、或另一聖職人員、甚或修道院院長者,提起任何能依法律或教規阻礙其祝聖的控告,則此種祝聖須予延緩,並須先插入對控告的審查,控訴人亦須到場,並將他所提出的指控追究到底。誠然,縱使控訴人缺席,或設法拖延,那將要行祝聖者,仍須在三個月內就此事進行最為精確的查察。
But if anyone institute any accusation, for whatever cause, against him who is to be ordained bishop, or presbyter, or deacon, or another cleric, or even the superior of a monastery, which could, according to the laws or canons, hinder his ordination, let such ordination be deferred, and let an examination of the accusation first be interposed, the accuser also being present and pursuing to the end those things which have been laid by him as a charge. Indeed, although the accuser absent himself, or contrive delays, nonetheless even so let him who is about to perform the ordination, within three months, hold a most exact inquiry concerning this matter.
69:16
Et siquidem eum qui accusatione in crimen vocatus fuit, sive secundum saeros canones, sive secundum nostras leges obnoxium invenerit, prohibetor ordinatio. Si vero innoxius apparuerit, celebrator ordinatio, sive praesente, sive absente accusatore. Accusator autem, sive præsens non probaverit, sive institutam accusationem deseruerit, siquidem clericus sit, proprio gradu depellitor; si laicus, cumpetentem coercitionem sustineto. At si quis accusatum ante examinationem ordinaverit, tam qui ordi. navit quam qui ordinatus est, uterque sacerdotio depeliitor. Prae omnibus autem illud custodiri sancimus, ut nemo per largitionem auri aut aliarum rerum ordinetur episcopus.
若他確然發現那被提起控告者,無論按聖教規還是按我們的法律,皆為有罪,則須禁止其祝聖。但若他顯為無辜,則須舉行祝聖,無論控訴人到場與否。而控訴人,無論是到場卻不能證實其控告,還是放棄了他所提起的控告,他若是聖職人員,須被逐出自己的品級;若是平信徒,須受相當的懲處。但若有人在審查之前便祝聖了被控者,那行祝聖者與受祝聖者二人,皆須被逐出司鐸職分。但在一切之上,我們批准須遵守此事:即無人得藉黃金或他物的賄賂而被祝聖為主教。
And if indeed he find him who was called into accusation as a charge to be culpable, whether according to the sacred canons or according to our laws, let the ordination be forbidden. But if he appear innocent, let the ordination be carried out, whether the accuser be present or absent. But the accuser, whether being present he do not prove it, or abandon the accusation he instituted, if he be a cleric, let him be expelled from his own grade; if a layman, let him sustain a fitting coercion. But if anyone ordain the accused before the examination, both he who ordained and he who was ordained, each, let him be expelled from the priesthood. But above all things we sanction that this be observed, that no one be ordained bishop through the bestowal of gold or of other things.
69:17
Si quid tale delinquatur, tam qui dant quam qui accipiunt, et mediatores eorum, ipsi seipsos condemnationi secundum divinas Scripturas et sacros canones subjiciunt. Ac propterea tam is qui dat quam qui accipit, et mediator existens, a sacerdotio aut clericali honore removetor. Quod vero per hanc causam datum fuerit, illi ecclesiæ vindicator cujtis sacerdotium voluit redimere. Si mundanus sit, qui per hanc causam accipit, aut mediator in negotio factus est, datas res in duplum ab eo exigi jubemus, vindicandas scilicet ecclesiv.
若有任何此類事被犯,那給予者與接受者、以及他們的居間者,皆依神聖經書與聖教規使自己陷於定罪。因此,給予者與接受者、以及居間之人,皆須被免除司鐸職分或聖職的尊榮。而因此緣由所給予之物,須歸於那他想要收買其司鐸職分的教會。那因此緣由而接受者、或在此事中居間者,他若是平信徒,我們命令向他加倍索取所給予之物,即須歸於教會。
If any such thing be committed, both those who give and those who receive, and their mediators, subject themselves to condemnation according to the divine Scriptures and the sacred canons. And therefore both he who gives and he who receives, and the one acting as mediator, shall be removed from the priesthood or clerical honor. But what was given by reason of this cause shall be claimed for that church whose priesthood he wished to purchase. If he who receives by reason of this cause, or who acted as mediator in the affair, be a layman, we command that the things given be exacted from him double, to be claimed, namely, for the church.
69:18
Non solum autem quae hoc modo data sunt vindicari praecipimus, sed etiam omnem cautionem pro hoc quocunque modo expositam, et pignorum ae fidejussoris obligationem, omnem denique aliam quamcunque actionem vacare sancimus. Atque insuper qui promissionem acceptavit, non solum confessionem reddito, sed etiam alterum tantum quantum confessione continetur exigitor, quod ipsum dari debet ecclesiæ.
但我們不僅命令收回那些以此方式給予之物,也批准廢除為此事以任何方式所設立的一切擔保、抵押與保證人的義務,以及最後任何種類的其他一切訴訟。此外,那接受許諾者不僅須交還所承認之數額,還須向他索取與承認書中所載相同的另一倍之數,而此本身須歸給教會。
But not only do we order those things which have been given in this manner to be reclaimed, but also every security exposed for this in whatever manner, and the obligation of pledges and of a surety, and finally every other action of whatever kind, we sanction to be void. And besides, he who accepted the promise shall not only render back the acknowledged sum, but also as much again as is contained in the acknowledgment shall be exacted, which itself ought to be given to the church.
69:19
Si quis tamen ex episcopis, sive ante ordinationem suam, sive post ordinationem, voluerit proprias res suas aut ex iis partem ecclesiæ cujus sacerdotium suscepit offerre, non solum id non prohibemus, et omni eum condemnatione ac pœna praesentis legis liberum esse sancimus, sed etiam omni laude dignum judicamus, quandoquidem id non emptio, sed oblatio est. Pro consuetudinibus vero illa solum ab his qui episcopi ordinantur praeberi concedimus, quae ordine deinceps praesente comprehenduntur lege.

If, however, any of the bishops, whether before his ordination or after his ordination, shall wish to offer his own goods, or a part of them, to the church whose priesthood he undertook, not only do we not forbid this, and sanction that he be free from all condemnation and penalty of the present law, but we even judge him worthy of all praise, since this is not a purchase, but an offering. But concerning customary dues, we grant that those alone be furnished by those who are ordained bishops, which are comprised in order hereafter in the present law.
69:20
Jubemus igitur ut beatissimi quidem archiepiscopi et patriarchae, hoc est senioris Romæ, Constantinopolis, Alexandriae, Tbeopolis, et Hierosolymorum, si consuetudo habeat ut episcopis aut clericis in eorum ordinatione minus quam viginti librae auri dentur, ea sola praebeant quae consuetudo agnoscit. Si plus anto hanc praebebatur legem, ne quid ultra viginti libras auri præbeatur. Metropolitani vero qui a synodo sua vel a beatissimis ordinantur patriarchis, neque non omnes alii, qni aut a patriarchis, aut a metropolitanis ordinantur, si quidem ejus ecclesia qui ordinatur non minus in reditu babeat quam triginta libras auri, dent pro enthroniastico quidem solidos centum;
因此我們敕令:至福的眾大主教與宗主教,就是長者羅馬、君士坦丁堡、亞歷山大、提阿波利斯與耶路撒冷的大主教與宗主教,倘若按慣例在主教或聖職人員受聖立時所給的金子少於二十磅,就只可供給慣例所承認的數額。若在本法之前所給超過此數,則不得供給超過二十磅金子。至於都主教,無論是由本省教會會議或由至福的眾宗主教所立的,以及一切其餘由宗主教或由都主教所立的人,倘若受聖立者的教會年收入不少於三十磅金子,就要為陞座禮獻金繳付一百索利杜斯;
We therefore decree that the most blessed archbishops and patriarchs, that is, of elder Rome, of Constantinople, of Alexandria, of Theopolis, and of Jerusalem, if it be customary that less than twenty pounds of gold be given to bishops or clerics at their ordination, are to furnish only that which custom acknowledges. But if more than this was being given before this law, let nothing beyond twenty pounds of gold be furnished. As for metropolitans, who are ordained by their own synod or by the most blessed patriarchs, and likewise all others who are ordained either by patriarchs or by metropolitans, if indeed the church of him who is ordained has in its revenue not less than thirty pounds of gold, let them give for the enthronement fee one hundred solidi;
69:21

and to the notaries of the ordaining prelate and to the others who are in his ministry and who customarily receive such, two hundred solidi. But if the church's revenue brings in for the year less than thirty pounds of gold, yet not less than ten, let them give for the enthronement fee two hundred solidi, and to all the others who customarily receive, one hundred solidi. If it should happen that the church's revenue is less than ten, yet not less than five pounds of gold, let them give for the enthronement fee fifty solidi, and to all the others who customarily receive, seventy-five solidi. If it has in revenue less than five, yet not less than three pounds of gold, let them furnish for the enthronement fee eighteen solidi, and to all the others who customarily receive, twenty-four solidi.
69:22
Si.ninus tribus, non minus autem duabus libris in quantitate rcdituum ecclesiæ inveniatur, dent pro enthroniastico quidem, solid. III; pro omni vero alia consuetudine, solid. vi. Episcopum enim ecclesiae quæ minus in reditu habet quam duas auri libras, nequo pro enthroniasticis, neque pro quacunque alia consuetudine dare aliquid concedimus. Hæc autem quæ præberi disposuimus, primus presbyter ordinantis episcopi et archidiaconus suscipientes, inter eos qui ei more capiunt dividunto. Hæc igitur jubemus omnihus observari modis, ne per hujusmodi occasiones ecclesiae praegraventur debitis, et sacerdotia fiant venalia.

If the church's revenue is found to be less than three, yet not less than two pounds, let them give for the enthronement fee three solidi, and for every other customary due, six solidi. For of a church which has in revenue less than two pounds of gold, we grant that the bishop give nothing whatever, neither for enthronement fees nor for any other custom. And these sums which we have appointed to be furnished, the chief presbyter of the ordaining bishop and the archdeacon, receiving them, shall divide among those who customarily receive from him. These things, therefore, we command to be observed in every way, lest by occasions of this kind the churches be burdened with debts and the priesthoods become venal.
69:23
Certe si quis ultra quantitatem a nobis definitam, enthroniasticorum aut consuetudinum nomine, quocunque modo capere aliquid pracsumpserit, jubemus ut quod amplius acceperit, id in triplum ex bonis ejus vindicetur ecclesiae illius qui dedit. Atque hæc quidem de ordinatione episcoporum dicta sunt. Post ordinationem vero tam servili quam ascriptitia fortuna episcopos liberos esse jubemus, nisi decurio aut cohortalis praeter prædictam observationem ordinatus sit. Ejusmodi enim remotos ab episcopatu, curiæ aut cohorti suæ restitui jubemus, ne qua ex tali fortuna sacerdotio oboriatur contumelia.
誠然,若有人以任何方式擅取超過我們所規定的數額,無論是以陞座禮獻金或慣例款項為名,我們命令凡他所多收的,要從他的財物中三倍償還給那獻金者所屬的教會。以上所說的都是關於主教的聖立。至於聖立之後,我們命令主教既脫離奴隸的身分,也脫離登記佃農的身分,除非有人違背上述規定而立為主教,他本是市議員或軍團隊員。這樣的人,我們命令把他從主教職位上革除,歸還其市議會或其軍團,免得從這樣的身分給聖職帶來羞辱。
Assuredly, if anyone presumes in any manner to take anything beyond the amount defined by us, under the name of enthronement fees or customary dues, we command that whatever excess he has received be recovered threefold from his goods for the church of him who gave it. And these things, then, have been said concerning the ordination of bishops. After ordination, however, we command that bishops be free both from servile and from registered-tenant condition, unless one has been ordained who is a decurion or a member of a cohort contrary to the aforesaid observance. For such men we command to be removed from the episcopate and restored to their curia or cohort, lest from such a condition any reproach arise to the priesthood.
69:24
Illos autem qui ante hanc nostram legem ex curiali forluna ordinati inveniuntur episcopi, sancimus quidem ut hujusmodi forluna liberi sint, sed legitimam partem ex bonis suis assignent curiæ et publico. Quod si contingat ut is qui ordinatur episcopus sub patris sui potestate sit, ex ipsa ordinatione sui juris esto. Porro Dei amantissimos episcopos et monachos nulla lege tutores aut curatores cujuscunque personæ lieri concedimus.
但那些在本法之先、被查明出自市議員身分而立為主教的人,我們固然敕令他們脫離這樣的身分,卻要他們從自己的財物中把合法的份額劃歸市議會與公庫。當然要這樣行,使教會的權益在那些財產上不受任何虧損,就是在主教任職之後另行取得、而我們已規定歸屬其教會的財產上不受虧損。倘若受聖立為主教者原在其父權之下,則因這聖立的本身,他就成為法律上自主之人。此外,我們准許那至愛神的眾主教與修士,按任何法律都不得被立為任何人的監護人或管財人。
But those who, before this our law, are found to have been ordained bishops from the curial condition, we decree indeed that they be free from such a condition, but that they assign the lawful portion from their goods to the curia and the public treasury. This, to be sure, in such a way that the rights of the church suffer no detriment in the property which, acquired in addition after the episcopate, we have appointed to belong to their church. But if it happen that he who is ordained bishop is under the power of his father, by the very ordination let him become legally independent. Furthermore, we grant that the most God-loving bishops and monks shall by no law be made guardians or curators of any person whatsoever.
69:25
Presbyteros autem, et diacouos, et subdiaconos, si jure ac lege cognationis ad tutelam aut curam vocentur, ejusmodi munus suscipere concedimus, si tamen intra menses quatuor exinde numerandos ex quo vocali sunt, apud competentem judicem scripto declaraverint id se munus propria voluntate suscepisse. Et si (ut probabile est) eorum aliquis hoc fecerit, nullum ex hoc præjumcium circa aliam tutelam aut curam sustineto.
至於長老、會吏與副會吏,倘若按親屬的權利與律法被召去擔任監護或管財之職,我們准許他們承擔這樣的職責,但條件是,他們須在受召之時起算的四個月內,在管轄的審判官面前以書面聲明,他們是出於自願承擔此職的。若(如所料)他們中有人這樣行了,他不可因此在任何其他監護或管財之事上受損。
But as for presbyters, deacons, and subdeacons, if by the right and law of kinship they are summoned to guardianship or curatorship, we grant that they undertake such a charge, provided, however, that within four months to be reckoned from the time they were summoned, they declare in writing before the competent judge that they have undertaken that charge of their own free will. And if (as is likely) any of them has done this, let him suffer no prejudice thereby with respect to any other guardianship or curatorship.
69:26
Sed neque susceptorem, aut exactorem publicarum contributionum, aut conductorem vectigalium, vel alienarum possessionum, aut curatorem familiæ, aut dispensatorem, aut procuratorem litis, aut fidejussorem pro his causis esse episcopum, aut oeconomum, aut cujuscunque gradus alium clericum aut monachum, concedimus, sive suo, sive ecclesiæ. aut monasterii nomine id subeat, ne per hanc causam sacris ædibus infligatur damnum, et divina impediantur ministeria.
但我們不准主教,或管家,或任何品級的聖職人員或修士,作公共捐稅的承收人或徵收人,或國庫收入或他人產業的承租人,或某家戶的管財人,或財務分配人,或訴訟代理人,或在這些事上作保人,無論他是以自己的名義,或以教會或修道院的名義承擔此事,免得藉此緣故使聖殿遭受損害,使神聖的職事受阻。
But we do not grant that a bishop, or a steward, or a cleric or monk of any rank, be a receiver or collector of public contributions, or a lessee of revenues or of others' possessions, or a curator of a household, or a dispenser, or a procurator of a lawsuit, or a surety in these matters, whether he undertake it in his own name or in that of the church or monastery, lest by this cause harm be inflicted on the sacred buildings and the divine ministries be hindered.
69:27
Caeterum si ecclesiis aut monasteriis aliquæ adjacere inveniantur possessiones, velintque venerabilium domuum dispensatores in conductionem aut emphyteusim eas accipere, tunc si omnes clerici et monachi de hujusmodi, causis, aut in ipso instrumento, aut sub actorum confectione, et consentiant, et declarent, ad utilitatem venerabilium domuum hoc fieri, proeedere et id genus conductionis seu emphyteuseos concedimus. Sedet ipsis sacrosanctis ecclesiis et reliquis venerabilibus domibus licentiam damus ut conductiones et emphyteuses inter se celebrent:
再者,若查明有些產業毗鄰教會或修道院,而那些敬畏之家的財務管理人願意以租賃或永佃方式承受這些產業,那麼,倘若一切聖職人員與修士在此類事上,無論是在文書本身中,或在備案的記錄之下,都同意並聲明此事乃為敬畏之家的益處而行,我們便准許他們進行這樣的租賃或永佃。我們也准許那至聖的眾教會本身與其餘敬畏之家,彼此之間訂立租賃與永佃契約;
Moreover, if any possessions are found to lie adjacent to churches or monasteries, and the dispensers of the venerable houses wish to take them on lease or in emphyteusis, then if all the clerics and monks consent and declare concerning matters of this kind, either in the instrument itself or under the drawing up of records, that this is being done for the benefit of the venerable houses, we grant that they proceed with such a lease or emphyteusis. And to the most holy churches themselves and to the other venerable houses we grant license to conclude leases and emphyteuses among themselves;
69:28
consimiliter et clericis, at suanI ecclesiarum possessiones conducant et gubernent, sententia tamen episcopi et oeconomi concedimUS, exceptis personis quas per alteram legem hoc facere prohibuimus. Si quis contra prædicta aliquid egerit. si quidem episcopus sii, omnes res ejus quæ ex quacunque causa aut persona, sive ante episcopatum, sive post episcopatum ad ipsum pervenerunt, ecclesiæ ejus vindicari sancimus.

and likewise we grant to the clerics that they lease and manage the possessions of their own churches, yet by the judgment of the bishop and the steward, with the exception of those persons whom by another law we have forbidden to do this. If anyone does anything contrary to the aforesaid: if indeed he be a bishop, we decree that all his property which, from whatsoever cause or person, whether before the episcopate or after the episcopate, has come to him, be claimed for his church.
69:29
Si vero œconomi, aut alii clerici sint, qui in hoc deliquerunt, pœna ab ipsis pecuniaria, quam episcopus eorum probaverit, exigitor, vindicanda ecclesiæ, quando et hi qui vectigalium aut cujuscunque possessionis conductionem, aut publicorum tributorum susceptionem profligationemve, sut curam familiæ illorum fidei crediderunt, aut promemoratis causis fidejussores eos acceperunt, nullam contra ecclesiam, aut monasterium, aut res ejus, aut dispensatores, aut etiam contra eas personas quarum fidem secutae sunt, aut facultates, aut fidejussores earum actionem habituri sint.
但若是財務管理人或其他聖職人員在此事上犯了過錯,就要從他們身上索取金錢罰款,其數額由他們的主教所核定,要歸入教會;同時,那些把收入或任何產業的承租,或公共貢賦的承收與清繳,或他們家戶的管理託付給他們的人,或接受他們在上述事上作保人的人,都不可對教會、或修道院、或其財產、或其財務管理人,甚至不可對那些他們所信賴的人、或其資財、或其保人,提起任何訴訟。
But if it be stewards or other clerics who have offended in this, let a monetary penalty be exacted from them, such as their bishop shall approve, to be claimed for the church; while those who entrusted to them the leasing of revenues or of any possession, or the receiving and discharging of public tributes, or the curatorship of their household, or who accepted them as sureties in the aforementioned matters, shall have no action against the church, or the monastery, or its property, or its dispensers, or even against those persons whose good faith they followed, or their resources, or their sureties.
69:30
Quin si quid publico damni obvenerit, illi qui publicarum contributionum aut vectigalium susceptionem, aut conductionem, aut profligationem memoratis personis crediderunt, aut lidejussores eos susceperunt, hoc ipsum ex propria substantia restituere compellentur. Praeterea nulli magistratuum licebit Dei amantissimos episcopos cogere, ut perhibendi testimoni causa in ejus prodeant; sed judex mittito ad eos quod ex personis ipsi apparentibus, ut propositis sanctis Evangeli:s, prout sacerdotes decet, dicat quæ noverunt. Sed neque ut episcopus pro pecuniaria aliqua aut criminali causa ad civilem militaremve magistratum invitus perducatur, sistaturve sine imperiali j ussione concedimus:
不但如此,若有任何損失臨到公庫,那些把公共捐項或收入的承收,或其租賃或清繳託付給上述之人的人,或接受他們作保人的人,就要被強制從自己的家產中償還這損失本身。此外,眾官長中無一人得強迫那至愛神的眾主教為作證之故出庭;卻要由審判官差人到他們那裡,使主教從那在審判官面前出現的人中間,按合宜祭司之體統,在所擺出的聖福音書之前,陳述他所知道的事。我們也不准主教為任何錢財或刑事案件,未經皇帝諭旨,就違其意願被帶到、或被強令出現於民事或軍事官長面前;
Nay rather, if any loss accrue to the public treasury, those who entrusted to the aforesaid persons the receiving of public contributions or revenues, or their leasing or discharge, or who accepted them as sureties, shall be compelled to make restitution of this very loss from their own substance. Furthermore, it shall be lawful for none of the magistrates to compel the most God-loving bishops to come forward in court for the sake of giving testimony; but let the judge send to them so that, from among the persons appearing before himself, the bishop may state what he knows, with the holy Gospels set before him, as befits priests. Nor do we grant that a bishop be brought against his will, or be made to appear without an imperial order, before a civil or military magistrate for any pecuniary or criminal cause;
69:31
sed magistratus qui hoc vel scripto vel sine scripto mandare præsumpserit, post cinguli detractionem viginti librarum auri pœnam persolvito, dandam ecclesiæ cujus episcopus perdu clus, aut sisti jussus est: consimiliter exsecutore quoque post cinguli detractionem tam tormentis subjiciendo, quam in exsilium mittendo. Interdicimus autem Dei amantissimis episcopis, ne proprias deserant ecclesias, et in alias proficiscantur provincias. but the magistrate who shall presume to give such a command, whether in writing or without writing, after the stripping of his belt of office shall pay a penalty of twenty pounds of gold, to be given to the church whose bishop was brought forth or ordered to appear; and likewise the officer who executes it, after the stripping of his belt, shall both be subjected to torments and be sent into exile. Moreover, we forbid the most God-loving bishops to desert their own churches and set out for other provinces. But even if some necessity of acting in this way arise, let them not do it otherwise than with letters from their most blessed patriarch or metropolitan, or, that is to say, by imperial command;
69:32
ita sane, ut ne illis quidem episcopis qui sub beatissimo archiepiscopo Constantinopolitano et patriarcha constituti sunt, sine ejus mandatu, aut nostra jussione ad regiam venire urbem liceat. Quod si eo modo episcopus quocunque loci peregrinetur, non amplius uno anno ecclesiam suam relinquito. Episcopi vero, qui ad regiam (ut dictum est) urbem accesserint, cujuscunque diœceseos sint, ante omnia beatissimum archiepiscopum Constantinopolitanum et patriarcham adeunto, atque ita per ipsum ad nostram ingrediuntur tranquillitatem.
當然要附此條件:就連那些在君士坦丁堡至福的大主教與宗主教之下所設立的眾主教,未經他的授命或我們的命令,也不得前來皇都。但若有主教以這樣的方式前往任何地方,他離開本教會不可超過一年。那些(如前所述)前來皇都的主教,無論屬哪一教區,首先都要謁見君士坦丁堡至福的大主教與宗主教,這樣才藉著他得以進入我們御前的安寧。
with this proviso, to be sure, that not even those bishops who are established under the most blessed archbishop and patriarch of Constantinople may, without his mandate or our command, come to the royal city. But if in such a manner a bishop journeys to any place whatever, let him not leave his church for more than one year. And the bishops who come (as has been said) to the royal city, of whatever diocese they may be, before all things let them approach the most blessed archbishop and patriarch of Constantinople, and thus through him let them enter into our serenity.
69:33
Qui vcro contra nostram dispositionem vel peregrinantur, aut ultra præfinitum anni tempus extra ecclesiam suam alibi commorantur, his primum quidem non subministrantor ab ecclesiae suæ œconomis sumptus: deinde citantor sacerdotum litteris, sub quibus censentur, ut ad ecclesias suas revertantur. Si reverti differant, secundum sacros evocantor canones. Et nisi intra tempus a sacerdotibus præfinitum ad ecclesias suas revertantur, ipsi quidem ab episcopatu depelluntor, alii amem meliores in ipsorum locum ordinanlor pro tenore praesentis legis. Eodem hoc obtenturo et in clericis, cujuscunque gradus fuerint seu ministerii.
但那些違背我們的法令、或出外遊歷、或在本教會之外別處逗留超過所定一年之期的人,首先,他們教會的財務管理人不可供給他們任何費用;其次,要憑那記載他們名籍之祭司的書信召喚他們,使他們回到本教會。他們若遲延不歸,就要按神聖的教規召喚。倘若他們在祭司所定的期限內仍不回到本教會,這些人就要被逐出主教職位,按本法的旨意立其他更好的人接替他們的位置。這同樣的條例也適用於聖職人員,無論他們屬哪一品級或職事。
But those who, contrary to our ordinance, either journey abroad or tarry elsewhere outside their own church beyond the prescribed term of one year, to these first of all let no expenses be supplied by the stewards of their church; next, let them be summoned by the letters of the priests under whom they are reckoned, that they may return to their own churches. If they delay to return, let them be summoned according to the sacred canons. And unless within the time prescribed by the priests they return to their own churches, these men indeed are to be driven from the episcopate, and others, better men, are to be ordained in their place according to the tenor of the present law. This same rule shall hold also in the case of clerics, of whatever rank or ministry they may be.
69:34
Quia vero quod a sacris dictum est canonibus de sanctissimorum episcoporum synodis, quæ per singulas celebrari debent provincias, hucusquc observatum non est, maxime necessarium fuerit ad rectam id denuo viam reducere. Ac sancti quidem apostoli et Patres definierunt ut bis per singulos annos religiosissimorum sacerdotum seu episcoporum in quaque provincia celebrarentur synodi, et quæ suppullularent, examinarentur, pOlirenturque competenti correctione: hoc est altera quidem quarta feria sanctae Pentecostes, altera vero in mense Septembri.
但因神聖教規所定關於那至聖眾主教的會議——本應在各省舉行的會議——至今未蒙遵守,所以把此事重新引回正軌乃是極為必要的。誠然,聖使徒與眾教父所規定的是:每年要兩次在各省舉行那至虔誠之祭司或主教的會議,凡所滋生的事都要受審查,並以合宜的更正加以整治:就是一次在聖五旬節的第四日,另一次在九月。
But because what has been said by the sacred canons concerning the synods of the most holy bishops, which ought to be held in each province, has hitherto not been observed, it has become most necessary to bring this back again to its right course. And indeed the holy apostles and Fathers defined that twice each year synods of the most religious priests or bishops should be held in every province, and that whatever sprang up should be examined and amended with suitable correction: that is, the one on the fourth day of holy Pentecost, the other in the month of September.
69:35
Nos autem ex hujusmodi negligentia multos variis implicitos peccatis invenerimus, jubemus ut omnibus modis in quaque provincia per singulos annos, vel in mense Julio, vel Septembri, una synodus celebretur, coeantque in unum apud beatissimos quidem patriarchas illi qui ab iis ordinantur, neque jus habent alios ordinare episcopos; apud religiosissimos vero cujusque provinciae metropolitanos hi qui ab ipsis ordinantur:
但因藉這類疏忽,我們發現許多人陷在各樣罪中,所以我們命令務必每年在各省舉行一次會議,或在七月,或在九月,並要聚集一處:在那至福的眾宗主教面前,是那些由他們所立、卻無權聖立其他主教的人;在各省至虔誠的都主教面前,是那些由他們所立的人:
But since through negligence of this kind we have found many entangled in various sins, we command that in every way one synod be held in each province every year, either in the month of July or in September, and that there assemble in one place, in the presence of the most blessed patriarchs, those who are ordained by them and have no right to ordain other bishops; and in the presence of the most religious metropolitans of each province, those who are ordained by them:
69:36
quo magis motae causae, et quae ab aliquibus denunuantur vel occasione fidei, vel canonicarum quæstionum vel administrationis rerum ecclesiasticarum, vel de episcopis, aut presbyteris, aut diaconis, aut aliis clericis, vel de monasteriorum præsulibus, aut monachis, vel de reprehensibili vita, aut aliis quæ correctionem desiderant, agitentur juxta et convenienter examinentur, neque non correctio iis adhibeatur duæ sacris canonibus et nostris conveniat legibus. Non tantum autem hæc quaerantur in synodis per singulos annos celebrandis:

so that the more the causes that have been stirred up, and those which are denounced by some, whether on occasion of the faith, or of canonical questions, or of the administration of ecclesiastical affairs, or concerning bishops, or presbyters, or deacons, or other clerics, or concerning the heads of monasteries, or monks, or concerning a blameworthy life, or other matters that require correction, may be agitated, so much the more fittingly may they be examined, and correction be applied to them such as accords with the sacred canons and our laws. But let not only these matters be sought out in the synods to be held every year:
69:37

Et veritate comprobata, unusquisque pro modo delicti canonicis censuris subjicitor judicio ejus qui causae examinationem accommodat.
而且每逢有人——無論是祭司、或聖職人員、或修道院長、或修士——被控告時,無論是關乎信仰,或關乎卑劣的生活,或因他行了違背神聖教規之事,也都要如此查究。若受控告者是主教,就由他的都主教審查所提出的事;若是都主教,就由那記載其名籍的至福大主教審查;若是長老、或會吏、或其他聖職人員、或修道院長、或修士,就由那記載他們名籍的至虔誠主教審查所控之事。真相一經查明,各人就要按其過犯的輕重,憑那承擔審理此案者的判決,受教規上的懲戒。
but also as often as anyone—whether of the priests, or of the clerics, or of the heads of monasteries, or of the monks—is accused, whether concerning the faith, or concerning a base life, or because he has done something contrary to the sacred canons. And if indeed he who is accused be a bishop, let his metropolitan examine the things that are brought forward; but if it be a metropolitan, let the most blessed archbishop under whom he is reckoned do so; if a presbyter, or deacon, or other cleric, or head of a monastery, or monk, let the most religious bishop under whom these are reckoned examine the things laid in accusation. And when the truth has been proved, let each one, according to the measure of his offense, be subjected to canonical censures by the judgment of him who undertakes the examination of the cause.
69:38
Atque hæc oinnia non tantum obtinento in iis episcopis et clericis, ncque non praesulibus, qui posthac ordinabuntur, sed eliam in iis qui modo sunt, si quis (quod Iicet cunjicere) de cerLis causis per sacros canones nostrasque leges prohibitis accusctur. His enim ita observatis, laici quoque magnum circa rectam fidem et honestam vitam profectum, atque in melius emendationem promerebuntur. Ad haec jubemus ut omne. episcopi pariter et presbyteri non lacito modo, sed clara voce, quae a fideli populo exaudiatur, sacram oblationem et preces in sancto baptismate adhibitas celebrent, quo rnajore exinde devotione in depromendis Domiti Dei laudibus audientium animi efferantur.
願這一切不僅在那些此後將受聖立的主教、聖職人員、以及修道院長身上有效,也在那些如今在職的人身上有效,倘若有人(如可推測的)被控以神聖教規與我們律法所禁止的某些案由。因為這些事既如此蒙遵守,平信徒也必在正確的信仰與正直的生活上大有長進,且得著向善的改正。為此我們再加一命令:眾主教與長老都要照樣舉行神聖的奉獻禮,以及聖洗中所用的禱告,不可用低聲的方式,乃要用清晰、可被信實之民眾聽見的聲音,好叫聽眾的心靈因此在頌揚主神的讚美上被激起更大的虔誠。
And let all these things obtain not only in those bishops and clerics, and likewise heads of monasteries, who shall be ordained hereafter, but also in those who now exist, if anyone (as it is permitted to surmise) be accused of certain causes forbidden by the sacred canons and our laws. For when these things are thus observed, the laity also will attain great progress toward the right faith and an honorable life, and amendment unto the better. To this we add a command, that all bishops alike and presbyters celebrate the sacred oblation, and the prayers used in holy baptism, not in a low manner, but with a clear voice that may be heard by the faithful people, so that thereby the souls of the hearers may be roused to greater devotion in giving forth the praises of the Lord God.
69:39
Ita enim et divus Aposlolus docet, dicens in prima ad Corinlhios EpisLola: Enim vero si solummodo oenedicas spiritu, quomodo qui privati locum implet dicet ad gratiarum actionem tuam Deo ipsum Amen, quandoquidem quid dicas non videt? Tu quidem pulchre gatias agis, alter autem non aedificatur. Et rursus in epistola ad Romanos sic inquit: Corde quidem creditur ad justitiam, ore autem fit confessio ad salutem. His igitur de causis convenit ut inter caeteras preces et ea quae in sancta oblatione dicuntur, clara voce a religiosissimis episcopis et presbyteris Domino nostro Jesu Christo Deo nostro cum Patre et sancto Spiritu proferantur:
因為那屬神的使徒也這樣教導,在哥林多前書中說:「不然,你若只用靈祝謝,那在不通方言之人地位上的,既然不曉得你所說的,怎能在你感謝的時候說阿們呢?你感謝固然是好,無奈別人不得造就。」他又在羅馬書中如此說:「因為人心裡相信就可以稱義,口裡承認就可以得救。」所以為這些緣故,合宜的是:在其餘的禱告以及神聖奉獻中所說的話之間,那向我們的主耶穌基督我們的神、連同父與聖靈所說的話,要由那至虔誠的眾主教與長老用清晰的聲音說出:
For thus also the divine Apostle teaches, saying in the first Epistle to the Corinthians: 'For indeed if you bless only in the spirit, how shall he who fills the place of the unlearned say the Amen to your thanksgiving to God, seeing that he does not perceive what you say? You indeed give thanks well, but the other is not edified.' And again in the Epistle to the Romans he says thus: 'For with the heart one believes unto righteousness, but with the mouth confession is made unto salvation.' For these causes, therefore, it is fitting that, among the other prayers and those things which are said in the holy oblation, the words to our Lord Jesus Christ our God, together with the Father and the Holy Spirit, be uttered with a clear voice by the most religious bishops and presbyters:
69:40
scituris religiosissimis sacerdolibus quod si quid horum neglexerint, et in horrendo judicio magni Dei et Servaloris nostri Jesu Christi de his rationem reddent, neque nos haec cognoscentes conquiescemus, relinquemusque inulta. Jubemus autem et provinciarum præsides, si quid eorum quae a nobis sancita sunt ne gligenter haberi viderint, ut primum quidem metropolitanos et alios episcopos urgeant au celebrandas prædictas synodos, et ut omnia impleant quae per synodos præsente lege praecepimus.
那至虔誠的眾祭司當曉得:他們若疏忽這些事中任何一件,既要在我們偉大的神、我們的救主耶穌基督那可畏的審判台前,為這些事交賬,我們知道了這些事,也決不會安然不問、任其不受懲罰。我們也命令各省的長官,倘若他們見我們所頒定的事中有任何一件被疏忽地對待,首先就要催促都主教與其他主教舉行上述的會議,並要他們成全凡我們在本法中所規定、要藉會議辦理的一切事。
the most religious priests being aware that, if they neglect any of these things, they will both render an account of them at the terrible judgment of our great God and Saviour Jesus Christ, and we, learning of these matters, will not rest content nor leave them unpunished. And we command also the governors of the provinces, if they see any of the things ordained by us being negligently handled, first indeed to urge the metropolitans and other bishops to hold the aforesaid synods, and to fulfill all the things which by the present law we have prescribed to be done through the synods.
69:41
Quod si eos moram nectere et segnius ea peragere viderint, lunc per suggeslionem nos ea de re certiores reddant, quo magis contra eos qui synodos celebrare differunt, conveniens a nobis procedat correctio: scituris tam ipsis praesidibus quam cohortibus qui illis obtemperant, quod si haec minus observaverint, extremis subjicientur suppliciis. Insuper interdicimus rcligiosissimis episcopis et presbyteris, neque non diaconis, et subdiaconis, ac lectoribus, et cuicunque alii cujuslibet venerabilis ordinis et gradus constituto clerico, He ad t abulam ludant, aut tali ludo utentibus se associent, aut spectatores sint, aut ad quodcunque spectaculum spectandi gratia accedant.
但若他們見這些長官拖延、並太懶散地辦理這些事,就要藉奏報使我們對此事更加確知,好使我們對那些拖延舉行會議的人施以更合宜的更正:那些長官本身,以及聽從他們的軍團,都當曉得:他們若太少遵守這些事,就要受極刑。此外,我們禁止那至虔誠的眾主教與長老,並會吏、副會吏、誦讀員,以及任何被立於任何敬畏品級與級位的其他聖職人員,玩擲骰棋盤,或與行此博戲的人為伍,或作觀者,或為觀看之故前往任何戲樂表演。
But if they see them causing delay and performing these things too sluggishly, then by a report let them make us more certain concerning the matter, so that the more a fitting correction may proceed from us against those who delay to hold the synods: both the governors themselves and the cohorts that obey them being aware that, if they observe these things too little, they will be subjected to the extreme penalties. Moreover, we forbid the most religious bishops and presbyters, and likewise deacons, and subdeacons, and readers, and any other cleric whatsoever appointed in any venerable order and rank, to play at the gaming-board, or to associate themselves with those using such gaming, or to be spectators, or to approach any spectacle whatsoever for the sake of watching.
